School refused to evaluate my child for an IEP. What can I do next?

My son is in second grade and his teacher keeps saying he is behind in reading and cannot stay seated. I emailed the principal asking for an IEP evaluation and got a phone call saying they want to try more interventions first. Do I just wait?

Put the request in writing again and be very direct: "I am requesting a full special education evaluation for suspected disability." Ask for Prior Written Notice if they refuse. Schools can use intervention data, but they generally should not use "let us try more things" to avoid considering an evaluation. Keep every email, note the date, and contact your state Parent Training and Information Center if the school still stalls. Timelines and consent rules vary by state, so get your state-specific clock confirmed.
